Application

These general rental terms apply to reservations and agreements concerning the vacation home “Blue Palm Curacao” located at Kaya Leydi 1-3, bungalow 10B, Willemstad, Curacao.
The term “tenant” refers to the person who enters into a rental agreement with us for the vacation home.
Any agreements deviating from these general terms are only valid if confirmed in writing.

1. General:

• The vacation home is for recreational use only and may not be used for any other purpose than a holiday stay.

• No parties or events allowed.

• Be mindful of neighbors: quiet hours after 10:00 PM.

• Subletting or transferring the rental is prohibited.

• The stay of more persons than agreed upon is not allowed without prior approval.

• Check-in: from 3:00 PM

• Check-out: by 11:00 AM (unless late check-out is booked)

2. Arrival and Departure:

• The vacation home is available from 4:00 PM on the day of arrival.

• You must vacate the home by 11:00 AM on the day of departure.

• Late check-out, if available, costs €50 and must be booked in advance.

3. Use of the Property:

• The house is non-smoking. Smoking is only allowed outside on the terrace with an ashtray.

• Pets are not allowed.

• Use of the property for parties, events, or commercial purposes is prohibited.

• An electric BBQ is available and must be cleaned after use. A €30 cleaning fee will be charged if not.

• Electricity and water usage will be deducted from the deposit. Be aware that both are expensive in Curacao. Use AC only with doors/windows closed.

• Turn off the AC when leaving the house and keep it at a moderate temperature (21–22 °C is sufficient).

• Do not use glassware at the shared swimming pool. Plastic cups are provided.

4. Damage and Liability:

• The tenant is liable for any damage caused during the stay by their actions or negligence.

• Damage must be reported immediately to the host or property manager.

• The property owner is not liable for theft, damage, or loss of the tenant’s personal belongings.

• Lock doors and windows when leaving the property.

• Use of the shared pool is at your own risk. Children must be supervised at all times.

• Do not leave small children unattended inside the house, especially near the open staircase and mezzanine which lack railings.

5. Payment & Cancellation:

• Booking is only final after payment of the deposit.

• 50 % of the total rental fee is due at the time of booking. The remaining amount is due 30 days before arrival.

• 100 % of paid deposits will be refunded for cancellations 60 days or more before arrival.

• 50 % of paid deposits will be refunded for cancellations 30 days before arrival.

• 0 % is refundable for cancellations within 30 days before arrival.

• In case of cancellation by the property owner (e.g., force majeure), the paid rental fee will be refunded.

• If the tenant fails to pay on time, the host may cancel the reservation and apply the above refund policy.

6. Cleaning:

• Keep the house clean during your stay (don’t leave food out – it attracts pests).

• Waste must be placed in closed bags and deposited in the designated containers at the resort.

• Final cleaning is mandatory and costs €135.

7. Deposit:

• A security deposit of €500 is required to cover any damage or costs incurred by the tenant or their guests.

• The deposit must be paid along with the invoice. If not, the rental agreement may be terminated immediately.

• The deposit or any remainder will be refunded within 14 days after departure, minus charges for electricity, water, or damages.

• If the deposit is insufficient to cover damages, the tenant remains liable for the balance.

8. Safety and Liability:

• The house has an open staircase and mezzanine without railing and is near a pool – it is not suitable for young children.

• Guests must supervise children at all times.

• The tenant is aware of these risks and accepts the use of the property and facilities at their own risk.

• The host is not liable for accidents, injuries, or damages during the stay unless caused by gross negligence or intent.
